Los Angeles County DMV Process – LA Driver Safety Office
During a typical DUI arrest in Long Beach, the police officer will confiscate the offender’s license and provide him/her with a temporary driver’s license.  The temporary driver’s license allows the driver to maintain full driving privileges for the next 30 days.  Should the driver take no further action, his/her license will become suspended.  The length of the suspension is determined by the number of actions the DMV has taken on the person’s license.  You have a right to fight this license suspension.  If you have been arrested for a DUI in Long Beach, it is imperative you contact the Driver Safety Office within 10 days of the date of arrest.  An experienced Long Beach DUI lawyer will request this hearing on your behalf as long as you have contacted the attorney within the first 10 days.  A competent defense attorney will request the APS hearing, in addition to a stay on the license suspension and discovery.  The Driver Safety Office will provide you with a new temporary license which will enable you to maintain full driving privileges up until the time a decision is rendered on the hearing.  The APS hearing is conducted by a representative of the DMV known as a Hearing Officer.  The Hearing Officer has the burden of proving the following issues:

If the driver submitted to a chemical test there are three issues:

  • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was the licensee lawfully arrested?
  • Was the licensee driving a motor vehicle with 0.08% or more, by weight, of alcohol in the blood?

If a chemical test was not taken (a refusal) the four issues are:

  • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was the licensee lawfully arrested?
  • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
  • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?
